1. Acceptance of Terms

By creating an account or using our services, you confirm that you:

  • Are at least 18 years old
  • Have the legal capacity to enter into this agreement
  • Have the authority to set up services on behalf of the protected person (if applicable)
  • Accept these Terms and our Privacy Policy

2. Description of Services

Protect & Assist provides:

  • Call Protection - AI-powered call screening, scam detection, and real-time monitoring
  • Care Plans - Medication reminders, health tracking, and family coordination
  • Family Dashboard - Access to call history, transcripts, and care information

Our services require a working phone line (landline, mobile, or VoIP) and internet access for the dashboard.

3. User Responsibilities

You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure
  • Obtain necessary consent from the protected person before setting up services on their behalf
  • Use the services only for lawful purposes
  • Not attempt to circumvent our security measures
  • Not use the services to harass, threaten, or harm others

4. Consent and Recording

Our call protection service may record, transcribe, and analyze phone calls. By using our services:

  • You consent to the recording of calls routed through our system
  • You agree to inform the protected person that calls may be recorded
  • You acknowledge that callers are notified that calls may be monitored
  • You understand that recordings are used for scam detection, quality assurance, and service improvement

It is your responsibility to ensure compliance with applicable recording consent laws in your jurisdiction.

5. Subscription and Payment

Our services are offered on a subscription basis:

  • Billing occurs monthly on the anniversary of your signup date
  • Prices are in US dollars and may be subject to applicable taxes
  • We accept major credit cards and process payments through Stripe
  • You authorize us to charge your payment method on a recurring basis

6. Cancellation and Refunds

You may cancel your subscription at any time:

  • Cancellation takes effect at the end of your current billing period
  • You retain access to services until the end of the paid period
  • Refunds are generally not provided for partial months
  • We may offer prorated refunds in cases of service issues at our discretion

7. Service Limitations

Please understand that:

  • No scam detection system is 100% accurate
  • We cannot guarantee prevention of all fraudulent calls
  • Service availability depends on your phone and internet connection
  • AI transcription may contain errors
  • Our care plan features do not replace professional medical advice

8. Intellectual Property

All content, software, and technology used in our services are owned by Protect & Assist or our licensors. You may not:

  • Copy, modify, or distribute our software
  • Reverse engineer our services
  • Use our trademarks without permission
  • Create derivative works based on our services

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our services are provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the 12 months preceding the claim
  • We are not responsible for losses resulting from scams that our system did not detect

10. Indemnification

You agree to indemnify and hold harmless Protect & Assist, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

11. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You use the services for illegal purposes
  • We are required to do so by law
  • We discontinue the services

Upon termination, your access to the services will cease, and we may delete your data according to our retention policies.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through our platform. Your continued use of services after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Texas.
